Terms of Service

1. FlowCalc and these terms

FlowCalc ("the Service") is an engineering calculation tool for sizing differential-pressure flow elements: orifice plates, nozzles, Venturi tubes and restriction orifices, based on published international standards.

It is operated by Control Engineering Sweden Aktiebolag, org. nr 556394-5947, VAT SE556394594701, Målaregatan 4, 426 68 Västra Frölunda, Sweden ("we", "us"). We are not affiliated with, endorsed by, or certified by any standards body, and FlowCalc is not a substitute for the standards themselves; you are responsible for holding any licences you need to the standards you rely on.

By using the Service, including the free trial, with or without an account, you agree to these terms. If you are agreeing on behalf of an employer or client, you confirm you have authority to bind that organisation, and "you" means that organisation. If you do not agree, do not use the Service.

2. Accounts and free use

You must be at least 18 and provide accurate information. You are responsible for everything done under your account and for keeping your sign-in secure. Tell us promptly at hello@flowcalc.cloud if you believe your account has been compromised.

You may run calculations without an account. Trial sessions are temporary and their data is deleted when the session ends. Free use is limited in how much you can save and in what the reports contain. We may change the limits of the free offering at any time.

3. Subscriptions, billing and refunds

Paid access is sold as an annual subscription priced per seat. A seat is one named individual; seats are not to be shared or used concurrently by multiple people. You may reassign a seat when someone leaves the team.

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Your purchase, payment details, taxes and invoices are therefore also governed by Paddle's terms and privacy policy.

Prices are exclusive of VAT and other applicable taxes. Paddle calculates these at checkout, and collects and remits them to the relevant authorities. Subscriptions renew automatically for successive annual terms unless cancelled before the renewal date. We may change prices for future terms with at least 30 days' notice before renewal.

Where we agree to invoice you directly (for example against a purchase order), we are the seller of that order rather than Paddle. We invoice in US dollars, payable within 30 days, and access starts when we confirm the order. If the invoice is not paid, access to paid features ends 30 days after the end of the period it covers.

You may cancel at any time under Billing in the app, which is also where you update payment details. Seats are added on the Team & billing page; to have fewer seats from the next renewal, tell us before the renewal date. Emailing us is not cancellation. Cancellation stops the next renewal and you keep access until the end of the term you have paid for. We offer a 30-day money-back guarantee. See Refund Policy, which forms part of these terms. Refunds of card orders are processed by Paddle.

4. Acceptable use

You agree not to:

  • share a seat between multiple individuals, or resell or sublicense access;
  • copy, scrape, or systematically extract the Service's calculations, tables or output in order to build or train a competing product or model;
  • reverse engineer or attempt to derive the source of the Service, except to the extent that restriction is unenforceable under applicable law;
  • interfere with the Service, or attempt to reach data belonging to other customers;
  • use the Service in breach of applicable law or export control and sanctions rules.

5. Your data

The calculation data, project information and files you put into the Service remain yours. You grant us only the licence needed to host, process, back up and display that data in order to operate the Service for you. We do not sell it, and we do not use it to train machine learning models.

Within a team workspace, data belongs to the organisation that owns the workspace, and its administrators can access, export and delete it. How we handle personal data is described in our Privacy Policy, which lists the subprocessors we use. Where we process personal data on your behalf we do so as your processor and you as controller; a data processing agreement is available on request from hello@flowcalc.cloud and forms part of these terms once signed.

After termination we may delete your data. Export anything you need before your subscription ends.

6. Engineering responsibility: please read

FlowCalc is a calculation aid. It is not a substitute for the judgement of a qualified engineer, and it does not carry professional or design responsibility for any installation.

Results depend entirely on the inputs, fluid properties, assumptions and standard revisions you select. You are solely responsible for verifying that the device type, operating conditions and validity ranges are appropriate for your application, for checking results against the applicable standard and against independent means, and for any decision to manufacture, install, operate or certify equipment.

Warnings and validity flags shown by the Service are aids, not guarantees; their absence does not mean a calculation is valid for your case. Do not use the Service as the sole basis for safety-critical, custody-transfer, or regulatory decisions without independent verification.

7. Availability and intellectual property

We aim to keep the Service available and to give notice of planned maintenance where practical, but we do not commit to a specific uptime level unless we have agreed one with you in writing. We may modify, suspend or discontinue features. If we discontinue the Service entirely during a term you have paid for, we will refund the unused portion.

The Service, its calculations, interface, documentation and the FlowCalc name remain our property. Subject to these terms and payment of the applicable fees, we grant you a non-exclusive, non-transferable right to use the Service during your subscription. Reports you generate are yours to use freely in your professional work.

8. Warranties and liability

To the fullest extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that its output will be free of inaccuracies.

To the fullest extent permitted by law, we are not liable for indirect, incidental, special or consequential loss, nor for loss of profit, revenue, production, contracts, goodwill or data, nor for the cost of repair, replacement, recall, rework, plant downtime or re-certification of equipment, however arising. Our total aggregate liability arising out of or in connection with the Service is limited to the amount paid for the Service in the twelve (12) months immediately before the event giving rise to the claim.

Nothing in these terms excludes liability that cannot lawfully be excluded, including liability for death or personal injury caused by negligence, for fraud, or any statutory rights you have as a consumer.

You will indemnify us against claims, losses and reasonable costs arising from your use of the Service in breach of these terms, or from third-party claims relating to engineering work, designs or installations in which you used the Service.

9. Suspension, termination and changes

We may suspend or terminate access if you materially breach these terms, if payment fails, or if your use threatens the security or integrity of the Service. Where reasonable we will warn you first and give you a chance to fix the problem. You may stop using the Service and close your account at any time.

We may update these terms. For material changes we will give notice by email or in the Service at least 30 days before they take effect for you. Continuing to use the Service after that means you accept the updated terms.

10. Governing law and general

These terms are governed by the laws of Sweden, without regard to conflict-of-law rules. Disputes will be brought before Göteborgs tingsrätt (Gothenburg District Court), Sweden. If you are a consumer, you keep the protection of the mandatory laws of your country of residence and may bring proceedings there.

If any provision is found unenforceable, the rest remains in force. Our failure to enforce a provision is not a waiver of it. You may not assign these terms without our consent; we may assign them as part of a merger, acquisition or sale of assets. These terms, together with the Privacy Policy and Refund Policy, are the entire agreement between us regarding the Service.
